LIMITED WARRANTY ON SILIENT LLC PRODUCTS

GENERAL

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

 

THE LIMITED WARRANTY CAN ALSO BE FOUND IN THE DOCUMENTATION WE PROVIDE WITH THE PRODUCT.

 

EXCEPT AS PROVIDED IN THIS WARRANTY POLICY, SILIENT PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND SILIENT, ITS OFFICERS, DIRECTORS, MANAGERS, EMPLOYEES, SUPPLIERS, PARTNERS, CONTENT PROVIDERS, AND AGENTS, DISCLAIM ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. SILIENT DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF THE USE, OF ITS PRODUCTS OR SERVICES. SILIENT DISCLAIMS ANY WARRANTIES REGARDING ACCURACY, TIMELINESS, RELIABILITY, CURRENTNESS, COMPLETENESS, FUNCTIONALITY, INTENDED PURPOSE, OR OTHERWISE.

 

USE OF THE PRODUCT IS NOT A MEDICAL PROCEDURE.  YOU SHOULD CONSULT WITH YOUR DOCTOR PRIOR TO USE AND YOU AGREE TO ADVISE ALL USERS OF THE PRODUCT TO CONSULT WITH THEIR DOCTOR PRIOR TO USE. THE PRODUCT HAS NOT BEEN TESTED OR APPROVED BY THE FDA OR ANY GOVERNMENT AGENCY FOR THE TREATMENT OF ANY ILLNESS OR DISEASE. DO NOT USE IF PREGNANT, HAVE HEART CONDITONS OR OTHER MEDICAL CONDITIONS NEGATIVELY IMPACTED BY EXPOSURE TO COLD TEMPERATURES, ARE A MINOR, OR WHILE UNDER THE INFLUENCE OF DRUGS OR ALCOHOL. ALL INFORMATION INCLUDED ON THE WEBSITE IS FOR INFORMATIONAL PURPOSES ONLY.

Silient, LLC (referred to as “Silient”, “us”, “we”, or “our” as the context may require) warrants that our water chiller and its component parts to be free from defects in materials and workmanship, under normal use and service, for the Applicable Warranty Period (as defined below). At its option, Silient will replace the defective component part(s), in accordance with the terms of this Limited Warranty, if it fails in normal use and service during the Applicable Warranty Period. The replacement component part(s) must be Silient original factory component Part(s). The replacement component part(s) will be warranted only for the unexpired portion of the original component part's Applicable Warranty Period.

This warranty is an integral part of our Terms of Sale https://www.silient.com/pages/terms-of-sale and you should carefully review our Terms of Sale before purchasing any Silient products.

EFFECTIVE DATE

The Effective Date of warranty coverage (the beginning of the Applicable Warranty Periods) is the date of purchase of this water chiller, if properly registered.

APPLICABLE WARRANTY PERIODS

Your Silient product was built to last. But even the best products can be affected by outside factors or issues in the manufacturing process. We back our equipment with the following warranties (each, an “Applicable Warranty Period”):

  • 1-Year Comprehensive Warranty on Chilling Components and SILIENT supplied parts
  • 10-Year Warranty on the Cold Tank

Proof of purchase is required to obtain warranty service. You can show proof of purchase with a dated sales receipt.

The warranties (collectively, the “Warranty”) include replacing parts manufactured or supplied by Silient that are shown, during the applicable Warranty period, to have defects in materials or workmanship that arise during normal use conditions. The Warranty period starts on the Effective Date.

Silient reserves the right to determine whether replacement or repair of a part or item is necessary. Silient may, at its discretion, either provide a replacement (substantially similar in nature) or have the product shipped to a Silient facility for repairs if unable to complete the necessary repairs on-site. Silient will cover the cost of the part(s) or replacement if a repair or replacement is deemed necessary. Customer is responsible for all shipping-related costs.

The Applicable Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.


LABOR ALLOWANCE

The Applicable Period for this Labor Allowance for all models is One (1) year from the Effective Date. The payment and amount of any payment are subject to approval at Silient’s sole discretion. The Labor Allowance will be paid based on Silient’s Schedule of Labor Allowances.

TRANSFERABILITY

This warranty is offered to the original and subsequent owners of the water chiller but is limited to the original address registered with the warranty only. The warranty will be void if the water chiller is relocated to any other location. In no event shall this warranty apply to any subsequent users or customers of the owners of the product.

WARRANTY EXCLUSIONS

IN NO EVENT SHALL SILIENT, ITS AFFILIATES, AND ITS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, MANAGERS, EMPLOYEES, AGENTS, SUPPLIERS, OR PARTNERS BE LIABLE FOR ANY LOSS OF USE, REVENUE OR PROFIT, OR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR SPECIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH SILIENT’S PRODUCTS WHETHER IN AN ACTION BASED UPON CONTRACT, TORT, OR OTHERWISE. MOREOVER, IN NO EVENT SHALL SILIENT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES OR LOSS DUE TO ANY MATTERS BEYOND SILIENT’S REASONABLE CONTROL.

NOTWITHSTANDING THE FOREGOING, TO THE EXTENT PERMITTED BY LAW, SILIENT’S TOTAL LIABILITY FOR ANY CLAIMS RELATED TO SILIENT’S PRODUCTS OR SERVICES, IS LIMITED TO THE AMOUNT PAID BY YOU FOR SILIENT’S PRODUCTS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING ANY CLAIM.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.


This warranty does not cover the following conditions:

  • Damages, malfunctions, or failures where you failed to strictly comply with the installation, technical, and site preparation specifications included in the Silient Guides, available at  www.silient.com/pages/technicalsupport, or any other applicable documentation provided by Silient to you (collectively, the “Guides”) at the time of installation or any time thereafter.
  • Damages, malfunctions, or failures where you failed to be in full compliance with applicable building codes and ordinances (or other similar applicable laws, rules, regulations, or codes) at the time of installation or any time thereafter. 
  • Damages, malfunctions, or failures resulting from failure to install the water chiller in accordance with applicable building codes, ordinances or normal plumbing and electrical trade practices;
  • Damages, malfunctions or failures resulting from improper installation or failure to operate and maintain the water chiller in accordance with the pre-installation checklist and the product’s instructions provided;
  • Damages, malfunctions, or failures resulting from operating the product outside of the acceptable temperature range of 55 degrees Fahrenheit to 90 degrees Fahrenheit;
  • Performance problems caused by improper sizing of the water chiller or the water supply line, electric service voltage, wiring or fusing;
  • Damages, malfunctions or failures caused by operating the water chiller with any parts removed or with parts that have been modified, altered or unapproved for installation;
  • Damages, malfunctions or failures caused by any other improper use of the products, including any improper use of the product by your customers or users;
  • Damages, malfunctions or failures caused by abuse, negligence, alteration, accident, fire, flood, freezing, lightning, other acts of God and other actions or events beyond our reasonable control;
  • Failures caused by operating the water chiller in a corrosive or contaminated atmosphere;
  • Damages, malfunctions or failures caused by poor water quality, lime or mineral build-up or sediment build-up;
  • Damages, malfunctions or failures caused by operating the unit at water temperatures outside the factory-calibrated temperature limits and/or exceeding the minimum setting of the temperature limit control;
  • Failures caused by operating the water chiller when it is not supplied with potable water at all times;
  • Units installed outside of the fifty states (and the District of Columbia) of the United States of America and outside of Canada;
  • Damage due to freezing; and
  • Damages, malfunctions or failures due to failure to perform preventative maintenance, including any suggested annual maintenance (including, without limitation, regular condenser cleaning), or due to unauthorized repairs or replacements.

WARRANTY CLAIM & RETURN PROCEDURES

To obtain warranty service for products covered by the Warranty that are still within the applicable Warranty period, please contact support@silient.com. Please provide us with the following information:

  • Name of purchaser
  • Address of Silient installation
  • Proof of purchase, included dated order confirmation and receipt
  • Item purchased
  • Details of alleged damage

All claims must be submitted within the Applicable Warranty Period.
